Modoc County Defendants Denied Bail Following Waive of Preliminary Hearing in Narcotics Case
ALTURAS, CA – Modoc County District Attorney Nina Salarno announced that defendants Tracy Tavernetti and Dennis Marcott appeared in Modoc County Superior Court before the Honorable Judge Harr and formally waived their preliminary hearing. Both individuals face multiple felony narcotics-related charges.
During the court proceedings, defense counsel argued for the release of the defendants. However, applying the legal standards from recent Kowalczyk and Humphrey case law, Judge Harr ordered both Tavernetti and Marcott remanded into custody without bail. The court determined that the allegations in the case presented a threat to public safety.
A subsequent Motion for Reconsideration was argued before the court. Following further argument and review, Judge Harr denied the motion and ordered that Tavernetti remain remanded in custody, again citing the application of standards under Kowalczyk and Humphrey.
The defendants are formally charged with multiple felony offenses, including the transportation, sale, and possession of controlled substances for distribution purposes. The charges also include conspiracy-related allegations and unlawful possession of a firearm. Additionally, the defendants face misdemeanor allegations involving narcotics possession and possession of drug paraphernalia.
District Attorney Salarno stated that the decision to remand the defendants without bail reflects the public safety concerns associated with the allegations, and noted that the office remains committed to prosecuting individuals involved in the trafficking and distribution of controlled substances within the community.
The Modoc County District Attorney’s Office expressed appreciation to the law enforcement agencies and investigators involved in the ongoing investigation. The case remains under active prosecution, and all defendants are presumed innocent unless and until proven guilty in a court of law.
