Suspect with a Suspended Driver’s License Arrested for Vehicular Manslaughter
RICHMOND, CA — Don J. Mack, 66, of Richmond, was arrested on August 30. Mack was booked on
suspicion of vehicular manslaughter and hit-and-run, while driving with a suspended license. He
remains in custody at the Martinez Detention Facility in lieu of $152,000 bond.
An 81-year-old man from Richmond, Rafael Gutierrez-Delgado, was struck in a crosswalk on August
23, shortly before 8:30 p.m. The driver fled from the scene without stopping with the victim on the car
hood. A moments later the victim flipped off the car and onto the roadway.
This fatal collision happened at the intersection of 23rd Street and Hellings Avenue in Richmond.
Gutierrez-Delgado had just left Restaurante Bahia de Jiquilisco, before he was struck and sustained
fatal injuries.
“Investigators immediately began working to identify the vehicle and the driver responsible,” Richmond
police said in a prepared statement. “Automated license plate readers and video-surveillance
technology provided investigators with critical leads.”
The vehicle owned by Mack was found two days later on August 25, parked on the 400 block of Fourth
Street. Richmond detectives next obtained a Ramey Warrant to arrest him. Mack was taken into
custody a few days later while leaving an apartment building on the same block, August 30 at 6:01
p.m.
When the hit-and-run occurred, Mack was driving with suspended license resulting from a DUI
conviction in December 2025. He also has other prior DUI convictions and driver’s license
suspensions on his record.
