Modoc Court Grants Probation to Repeat Felony DUI Offender Despite Objections from District Attorney’s Office
ALTURAS, CA — Proceedings in the Modoc County Superior Court concluded with a probationary sentence for an individual convicted of felony evading a peace officer and felony driving under the influence (DUI) with multiple prior offenses. On Tuesday, December 2, 2025, 29 year-old Javier Adrian Walker received a sentence from Judge Wendy Dier.
Walker’s conviction for felony DUI included the aggravating factor of having three or more prior DUI convictions. Court records indicate Walker was also on probation for two DUI convictions stemming from the previous year. Walker has additional prior DUI convictions in Nevada (2018) and Oregon (2021). The offense leading to the recent sentencing reportedly took place just one month following the completion of court-ordered substance abuse treatment related to his earlier DUI cases.
The Modoc County District Attorney (DA), Nina Salarna, stated her disagreement with the court’s sentencing decision following the hearing. The DA’s office had argued for the upper term of three years and eight months in state prison, citing what they characterized as Walker’s ongoing risk to public safety. The Probation Department also recommended a custodial sentence of two years and eight months in prison. Additionally, the victim in the most recent case delivered an impact statement during the sentencing hearing.
Judge Dier ultimately sentenced Walker to a new term of probation alongside a period of county jail time. The judge stated that this disposition was intended to provide Walker with another opportunity to continue treatment under what were described as more conducive circumstances. DA Salarna publicly objected to the decision, asserting that Walker has demonstrated an incapacity for rehabilitation and that continued instances of driving while intoxicated are foreseeable. The DA’s office stressed that the sentence does not adequately address the potential for future harm to the public. The Modoc County District Attorney’s office stated that they are available for questions regarding the outcome of the case.
