Fugitive Arrested in Las Vegas for a Murder and Shooting in Bay Point

BAY POINT, CA — A fugitive awaits extradition to California to face first-degree murder and attempted
murder charges.

Avery A. Gibbs, 35, of Antioch, was arrested by Las Vegas police on July 9,
collaborating with the Contra Costa County Sheriff’s Office.

Gibbs allegedly killed Ernest Hayes, 44, of Pittsburg, on July 3. Hayes was fatally shot on Olivia Lane
in an unincorporated area of Bay Point. The victim was transported to a hospital, where he was
pronounced dead, as a result of multiple gunshot wounds.

Gibbs also allegedly shot a second man who intervened during a confrontation between Gibbs and
Hayes. The second unidentified victim was treated for gunshot wounds at a hospital and he survived,
according to the Contra Costa County Sheriff”s Office.

The gunman fled before deputies arrived at the crime scene shortly after 1:30 a.m. Homicide
detectives interviewed witnesses and identified Gibbs as the suspect. A warrant was obtained to arrest
Gibbs, but he had already fled from California.

Investigators learned that Gibbs fled to Nevada, and they collaborated with police there. Las Vegas
police executed a high-risk stop to apprehend Gibbs, without further incident. Gibbs remains in
custody at Clark County Detention Center, pending extradition proceedings.

Gibbs has a criminal record California, and he has served time in prison. He was convicted for human
trafficking of minors and pandering/pimping in 2016. Gibbs was also convicted for second-degree
robbery in 2011. If Gibbs is convicted for his new charges, he faces a potential sentence of life in
prison.
