The suspects tried to avoid officers and swerved towards them before fleeing at a high rate of speed.  According to police, “while attempting to escape, the driver of the stolen car collided with another vehicle in the intersection of S. Milpitas Boulevard and Montague Expressway.”  This allowed for officers to take the two suspected occupants into custody.

Delfin was identified as the driver as Mercado rode shotgun.  During a search of the duo they found that Delfin was in possession of a .22 caliber ammunition while Mercado was found to be in possession of methamphetamine, along with two shaved keys used to try and steal cars.

A search of the stolen car produced a loaded .22 caliber revolver, narcotics pipe, and stolen license plates.

Delfin was booked into the Santa Clara County Main Jail for possession of a stolen car and stolen property, possession of a stolen car with a prior conviction, assault with a deadly weapon, and for being a convicted felon in possession of a firearm and ammunition.
