Santa Cruz County Sheriff issues statement on tobacco sales compliance check

“On Sunday, March 1, 2020, members of the Santa Cruz County Sheriff’s Office Alcohol and Tobacco Compliance Units conducted a decoy and sales of tobacco compliance operation at the local Santa Cruz Flea Market in Santa Cruz County. The goal of this operation is to limit minors’ access in the community to tobacco products in addition to ensuring all tobacco sales are with a licensed retailer.

Decoys are under 21 years of age and are under the direct supervision of the Compliance Deputies during the operation. During this operation, the decoy attempted to purchase tobacco products from a private vendor at the flea market. Altogether, approximately 1,000 tobacco products were seized in excess retail value of $8,000.

In total, three separate vendors were cited for various tobacco related violations:

• 308(a)(1)(A)(i) PC – Selling tobacco products to a minor
• 22972(a) BP – Retailing without a State tobacco license
• 5.60.030 SCCC – Retailing without a County tobacco license
• 5.60.040 (I) SCCC – Sale of flavored tobacco product

During the operation, each offending vendor was issued a citation with a future court date and all tobacco products, including paraphernalia and electronic cigarette products, were seized as evidence.”
