Proposition 36 Applied in Arrest for Possession of Methamphetamine on Jail Property

SAN BERNARDINO, CA  —

INCIDENT: Possession of Suspected Methamphetamine on Jail Property PC 4573(a) & Treatment Mandated Felony H&S 11395(b)(1)

LOCATION: 18000 Institution Road, Glen Helen Rehabilitation Center/Work Release

SUSPECT(S): Richard Minks, 54-year-old Resident of Colton

VICTIM(S): State of California

SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:

On May 2, 2025, at approximately 8:24 a.m., Deputy Ramirez and Deputy Strathmann were driving through the Work Release parking lot, conducting a jail safety and security check. Deputy Ramirez observed an SUV commit a vehicle code violation, and a vehicle check was conducted. During the contact deputies determined one of the occupants was on probation for assault with a deadly weapon.

A search of the vehicle was conducted by the deputies. Deputy Ramirez located a glass pipe which had a white coating of suspected methamphetamine inside of it. Also located was a clear plastic baggie which contained approximately one gram of suspected methamphetamine. The contraband was determined to belong to Richard Minks. Minks was placed under arrest and was transported to Central Detention Center. During the booking search, Deputy Ramirez recovered another plastic baggie containing approximately six grams of suspected methamphetamine from the inside of Minks’ shoe.

Minks was arrested for PC 4573(a) Possession of Drugs on Jail Property and H&S 11395(b)(1) Treatment-Mandated Felony with Two Prior Drug Related Convictions (Proposition 36).

The San Bernardino County Board of Supervisors authorizes the Sheriff to administer a Work Release program. While providing manual labor to improve or maintain public facilities, inmates may re-establish ties with their family, return to work with their previous employers, while serving the community on their non-scheduled workdays. Inmates who have been sentenced to Work Release by the courts also have the option of participating in Glen Helen Rehabilitation Center’s Electronic Confinement Program (ECP). It is the duty of the Work Release division to ensure that all commitments are held accountable to all California State Laws while participating in the program to provide safety and security for the community.
