‘Inventive’ Boatman Arrested after Fighting Police at San Rafael Yacht Harbor

SAN RAFAEL — David J. Moses found himself in some unfortunate trouble on the waterfront last week. The 51-year-old boatman from San Rafael was arrested after a fight with police. The suspect fancies himself as an inventor who is above the law.

Moses allegedly became violent at San Rafael Yacht Harbor, where he was observed guiding his unregistered boat. He apparently over-reacted when an officer detained him for illegal mooring and anchoring.

Moses was contacted while walking along a dock to discuss his boat situation. According to SRPD, he refused to follow an officer’s directions. He attempted to push passed the officer. He next became physically combative with the officer.

The ensuing fight continued for about a minute, until another officer intervened and assisted in subduing the suspect. For his actions, Moses was arrested on January 29 at 11:42 a.m., outside a nearby flooring store at 555 Francisco Boulevard East.

It seems Moses claims he is a “sovereign citizen” not subject to laws. He’ll have another opportunity to explain this to a judge during a court hearing scheduled in March.

Moses faces charges for allegedly taking a non-firearm weapon from a police officer, and battery on an officer. In addition, he also faces charges for obstructing an officer and probation violation. He remains in custody at Marin County Jail in lieu of $15,000 bond.

Moses frequently spends time behind bars at the county lockup. He was arrested twice during each of the successive years of 2021, 2020 and 2019. These prior incidents involved battery, petty theft, trespassing, and failure to provide evidence of financial responsibility.
