Four arrested in drive-by shooting of San Jose man near Mexican eatery

SAN JOSE – The San Jose Police Department has announced the arrest of four suspects in the the drive-by shooting death of 29-year-old Juan Garcia.

According to SJPD Officer Gina Tepoorten, “On Monday, February 4, 2019, at about 10:07 PM, San Jose police officers responded to a person shot in the 3100 block of Cadillac Drive in San Jose.”

The suspects, 21-year-old Jose Rosales, 19-year-old Emilio Avila, 18-year-old Victor Martinez, and 24-year-old Ruben Huezoortiz were each served an arrest warrant implicating them in Garcia’s shooting, which reportedly occurred near a Mexican diner.

Two of the suspects were already being held in custody on unrelated charges.

According to Tepoorten, “Suspect Emilio Avila was also served with the arrest warrant while in custody at Elmwood Correctional Facility in Milpitas on unrelated charges.” Jose Rosales was already in custody at the Santa Clara County Main Jail.

Two other suspects were also served arrest warrants on May 24, 2019, by the San Jose Police Department’s Covert Response Unit, leading to Victor Martinez and Ruben Huezoortiz’s arrests in San Jose for murder.
