Man Charged in Fatal Baseball Bat Attack

SACRAMENTO – A dispute between two men in Orangevale last week has left one man dead and the other sent to jail, according to an official press release by the Sacramento County Sheriff’s Department.

Brandon Biagioni, 32, was reportedly booked into the Sacramento County jail last Thursday, June 6, 2013, on a charge of murder for the death of James Marlow, 62. He is being held without bail.

According to the Sheriff’s Department, on June 6 shortly before 6:30pm, deputies responded to the 9200 block of Pershing Avenue regarding a trespasser. A woman reported she was house-sitting for a friend, and a former tenant on location was present and refusing to leave. The woman had become afraid for her safety and called her husband to come and protect her until deputies could arrive.

En route, deputies reportedly received an update that the complainant’s husband — later identified as Marlow — had been assaulted by the former tenant — later identified at Biagioni — with a baseball bat.

Upon arrival, Sheriff’s deputies reportedly found Marlow and his wife outside the home. Although Marlow had sustained head injuries from the attack, he was able to provide a statement to deputies where he identified Biagioni as the assailant.

Moments later, Biagioni reportedly exited the home, was detained without incident, and transported to the Sacramento County Main Jail.

Marlow was reportedly taken to a hospital for evaluation and treatment, where several hours later he succumbed to his injuries and was pronounced dead by medical staff.

Further investigation by detectives revealed Marlow had brought the bat to the home as a means to defend himself and his wife if necessary. Investigators believe Biagioni launched an unprovoked assault on Marlow, knocking him to the ground before grabbing the bat and striking him in the head.
