Convicted Pedophile David Allen Funston Charged in Placer County After CDCR Release

PLACER COUNTY, CA  — Feb. 27, 2026

David Allen Funston, 64, was convicted in 1999 of 16 counts of kidnapping and child molestation involving multiple young children, some as young as four. He received more than 20 years in prison plus three consecutive sentences of 25 years to life in Sacramento County.

Despite those life sentences, he was recently granted early release under California’s Elderly Parole Program, which allows inmates over age 50 to be considered for parole.

New Charges Filed

Following his release from the California Department of Corrections and Rehabilitation, the Placer County District Attorney’s Office refiled charges against him for a 1996 sexual assault of a child in Roseville, located in Placer County.

At the time of the original prosecution, Placer County did not pursue separate charges because his Sacramento County life sentences were expected to permanently remove him from society. However, his early release changed that calculation.

Placer County District Attorney Morgan Gire stated that due to changes in state law and parole board decisions, the office determined it was necessary to act to ensure community safety. The 1996 case was refiled within the statute of limitations.

Current Status

A no-bail warrant has been issued.

Funston is currently in custody in the Placer County Jail.

He is scheduled to be arraigned in Placer County Superior Court early next week.

The case has sparked public anger and debate over California’s Elderly Parole Program, particularly regarding whether individuals convicted of heinous crimes should qualify for early release.
