An altercation between gang members leads to vehicular manslaughter

Two suspects have been arrested in the City of San Jose’s 7th homicide of 2014. The San Jose Police Department has filed charges against the pair for a vehicular homicide that occurred on February 16 that resulted in the death of Eric Vallejo during an altercation between the couple and the victim. Vallejo was run down near Capitol Expressway and Snell Avenue, near the Capital Flea Market in San Jose.  24-year-old Andrew Reynoso was arrested on Saturday, February 22. 21-year-old Davinna Mariscal had already been arrested on Tuesday, February 18.

The San Jose police responding to the scene reported that a fight between two groups of people began inside the flea market. When it was apparent the fighting had gotten out of hand, security officers told them to leave. People in the groups continued to fight outside of the flea market. The fighting eventually ended when Andrew Reynoso ran over 23-year-old Eric Vallejo in the street.

According to Sergeant Heather Randol of the SJPD, “The initial investigation determined this incident was gang related. A second suspect, Davinna Mariscal, was also taken into custody on February 18, 2014, for being an accessory after the fact and booked into the Santa Clara County Jail.”

Homicide detectives working the case are currently looking for a charcoal colored 2008 E-550 Mercedes Benz with license plate 7DMZ599 with rear end damage. They are asking the public for any information that might lead them to the vehicle used during the incident. Persons with information regarding the above case are urged to contact Detective Sgt.
