Sexual assault suspect released after DA drops charges

SANTA CLARA COUNTY – The Santa Clara County Sheriff’s Department made an arrest on Wednesday, January 2nd, 2019, after a call came in that a woman reported being sexually assaulted by a transient male that she was reportedly trying to help.
The alleged sexual assault occurred around 6:30 in the evening when the woman says she was approached by 43-year-old Sharwian Bobian, who had been provided food, toiletries, and a heater while he camped in a makeshift shelter on Llagas Avenue near an elementary school and church in San Martin.
The female victim asserted to deputies that, as she was bringing food and supplies to Bobia,  that he supposedly took her inside the make-shift shelter and sexually assaulted her.
According to Sgt. R. Glennon, “Patrol Deputies located Bobian at the shelter and took him into custody.” Bobian was booked into Santa Clara County Main Jail on charges of sexual assault and false imprisonment. However, after a brief review of the case, the suspect was released after the Santa Clara County District Attorney’s Office had declined to charge him citing that the case was still under investigation.
