Driver Accused of Trying to Run Over Cop Wants His Car Returned

Acton Street

BERKELEY – Derrick L. Garcia, a 57-year-old maintenance man from Richmond, was arrested April 23 on suspicion of nearly running over a Berkeley police officer, during what otherwise would have been a routine traffic stop for a vehicle code violation.

Garcia is accused of abandoning his SUV on the 1300 block of Derby Street and running away, after almost clobbering an officer who pulled over the suspect on Acton Street at 3:50 p.m. last Saturday.

The suspect got away and eluded capture by police, who set up a perimeter in the neighborhood.

Garcia was arrested the next day, when he showed up at the Berkeley police station and attempted to retrieve his impounded vehicle.

Garcia is charged with assault with a deadly weapon (his vehicle) and recklessly evading a police officer. His bond for release from Berkeley Jail was set at $70,000.
