A recent booking photo of Stewart was used to help identify him as the person seen in video surveillance stealing the television sets.  Security at the hospital reviewed footage showing Stewart entering the hospital, where he had gone for treatment at the emergency room. Once he was finished, he began to unfasten the televisions, and readied them for transport to his vehicle.  The video footage was able to identify Stewart from the Medical band emergency room workers had placed on his wrist just moments before.  Based on these findings it was determined that Stewart had once again gone to the hospital in order to steal more television sets.

Tim Moore, the prosecutor for the Santa Clara District Attorney’s office said, “Stewart is facing two counts of second degree burglary and a prison prior.”  According to Moore, “The prior (triggered by having a previous felony in the past five years) could add a year on to his sentence, if convicted.”  His next court date has been set for Dec. 23, 9 a.m., for a plea.
